General Information: Any software and technical support services provided to you are Licensed, not sold, to you by A&B Business Equipment, Inc. for use only under the terms of this License. A&B Business Equipment, Inc. reserves all rights not expressly granted to you. The rights granted herein are limited to A&B Business' intellectual property rights and their exclusive proprietary rights to software and services provided to you under this License. 2.) Permitted Use: This License allows you to install, use and employ A&B Business software, materials, and technical support services. This License does not allow the A&B Business software or technical support services to exist or be provided on more than one computer or to more than one customer at a time. 3.) Transfer: You may not rent, lease, loan or sublease the A&B Business software, materials, or technical support services to any other party. 4.) Termination: This License is effective until terminated. Your rights under this license will terminate automatically without notice from A&B Business if you fail to comply with any term of this License. Upon termination of the License, you shall cease all use of A&B Business' software, materials, or technical support services, or any other information provided to you by A&B Business. 5.) Warranty: A&B Business makes no warranties, either express or implied, regarding the software, material, and technical support services provided under this License. If a dispute arises, your sole remedy shall be a proportional refund of the software purchased and technical support services provided by A&B Business. You will, however, remain responsible to A&B Business under the terms of any independent technical support contract and this License agreement shall in no way impair or effect any independent technical support contracts entered into by you with A&B Business. 6.) Disclaimer: You expressly understand and agree that the use of the software, materials, and technical support services provided to you by A&B Business are offered and accepted by you at your own risk of use. You assume the risk of satisfaction quality, performance, accuracy and effort under this License agreement. Any and all software provided is provided "As is," with all faults and without warranty of any kind. Installation of any software provided by A&B Business may affect usability of other third party software. You hereby agree that A&B Business is not liable for any such affects. In addition, you further agree that A&B Business is not responsible for any damage to any computer hardware caused by either software installation or technical support services provided to you by A&B Business. 7.) Limitation of Liability: To the extent not prohibited by law, in no event shall A&B Business be liable for personal injury, or any incidental, special, indirect or consequential damages, or damages to computer hardware, whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruptions or any other commercial damages or losses, arising from use of or inability to use A&B Business software, materials, or technical support services, however caused. 8.) Choice of Law and Venue: This License is governed by and construed in accordance with the laws of the state of South Dakota and you agree to Minnehaha County as the proper venue for any dispute arising under this License agreement. 9.) Complete Agreement: This License constitutes the complete and entire agreement between the parties with respect to the use of any of A&B Business' software, materials, or technical support services licensed hereunder and supercedes all prior or contemporaneous agreements regarding this License. Do you accept all of the terms of the preceding License agreement? If you chose no, you will not be able to download the requested software. To receive A&B Business software, materials, and technical support services, you must accept this agreement.
